Your participation in the program is solely to legally promote our website in order to receive a commission for memberships and products purchased by people referenced by SecretUndies through your own website or personal recommendations. By signing up for the SecretUndies Affiliate Program (Program), you agree to this Agreement and its terms.

Approval or refusal of the application

We reserve the right to approve or reject EVERY Partner Program application in our sole and absolute discretion. You have no legal remedy against us for rejecting your affiliate program application.

Commissions

The commissions are paid once a month. For an affiliate to receive a commission, the advertised account must remain active for at least 31 days. You can’t recommend yourself, and you won’t get a commission on your own accounts. Payments are sent only for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be paid out.

Termination

Your partner application and status in the program may be suspended or terminated for any of the following reasons:

• Inappropriate advertising (false claims, misleading hyperlinks, etc.).
• Spamming (mass emails, mass newsgroup postings, etc.).
• Advertising on websites that contain or promote illegal activity.
• Failure to disclose the affiliate relationship for a promotion that is considered endorsement under existing Federal Trade Commission policies and regulations or applicable state laws.
• infringement of intellectual property rights. SecretUndies reserves the right to request license agreements from those who use SecretUndies trademarks to protect our intellectual property rights.
• Offer discounts, coupons or other promised kickbacks from your affiliate commission as an incentive. However, adding bonuses or bundling other products with SecretUndies is acceptable.
• Self-recommendations, fraudulent transactions, suspected affiliate fraud.

In addition, SecretUndies reserves the right to terminate any Affiliate Account at any time for breaches of this Agreement or without giving reasons.

Affiliate links

You can use graphic and text links both on your website and in your email messages. You can also promote the SecretUndies website in online and offline classifieds, magazines and newspapers. You may use the graphics and text we provide or create your own as long as they are deemed appropriate under the Terms and do not violate the terms described in the Termination section.

Coupon and Deal Sites

SecretUndies occasionally offers vouchers for selected affiliates and for our newsletter subscribers. If you have not pre-approved/assigned a brand coupon, you are not allowed to promote the coupon. Below are the terms and conditions applicable to any affiliate considering advertising our products in relation to a business or coupon:

• Affiliates may not use misleading text on affiliate links, buttons or images to imply that anything other than currently authorized trades with the respective affiliate.
• Affiliates may not bid on SecretUndies coupons, SecretUndies discounts, or other phrases that indicate that coupons are available.
• Affiliates may not generate pop-ups, pop-unders, iframes, frames, or other seen or invisible actions that affiliate set cookies, unless the user has a clear and express interest in activating a particular saving by clicking on a clearly marked link, button, or image for that particular coupon or deal. Your link must direct the visitor to the merchant page.
• The user must be able to see coupon/deal/savings information and details before setting an affiliate cookie (i.e. “click here to see coupons and open a window to the merchant website” is NOT allowed).
• Affiliate sites may not have a “click for (or to see) deal/coupon” or variation if no coupons or deals are available and the click opens the merchant site or sets a cookie. Affiliates with such text on the merchant landing page are immediately removed from the program.

Pay-per-click policy (PPC)

PPC bids are NOT allowed without prior written permission.

Liability

SecretUndies is not liable for indirect or accidental damage (loss of sales, commissions) due to affiliate tracking errors, loss of database files or consequences of damage to the program and/or our websites. We do not give any express or implied guarantees in relation to the Program and/or the memberships or products sold by SecretUndies. We make no claim that the operation of the program and/or our website(s) is error-free and we are not liable for interruptions or errors.

Duration of the agreement

The term of this Agreement begins with your inclusion in the Program and ends when your Affiliate Account is terminated. The terms of this Agreement may be amended by us at any time. If changing the terms of this Agreement is not acceptable to you, your only choice is to cancel your affiliate account. Your continued participation in the Program constitutes your acceptance of any change.

Confirmation code

The Affiliate indemnifies SecretUndies and its affiliates, officers, directors, employees, licensees, successors and assignees, including those licensed or authorized by SecretUndies to transfer and distribute materials, from any liabilities, damages, fines, judgments, claims, costs, losses and expenses (including reasonable legal fees and expenses) arising out of or in connection with any claims arising in connection with this Agreement due to negligence. Misrepresentation, non-disclosure or intentional misconduct of the affiliate.

Electronic signatures effective

The Agreement is an electronic contract that sets out the legally binding terms of your participation in the SecretUndies Partner Program. You agree to this Agreement and any terms contained or referenced in this Agreement by completing the SecretUndies application process. This measure creates an electronic signature which has the same legal force and effect as a handwritten signature.
