SecretUndies.com is operated by SecretUndies Ltd. (registered office: Republic of Cyprus; current company details, including its registration number and address, are provided in the Legal Notice). The platform facilitates discreet, anonymous C2C trade in second-hand intimate clothing (including items marked as “worn”) between registered users in the DACH region.

By registering and using the platform, users acknowledge Part 1: General Terms and Conditions (GTC) and Part 2: Terms of Use (House Rules) as binding. The two parts complement each other; in the event of a conflict, more specific provisions in the Terms of Use take precedence over the general provisions of the GTC.

Part 1: General Terms and Conditions (GTC)

§ 1 Scope and definitions

(1) These General Terms and Conditions apply to all contracts, rights and obligations between SecretUndies Ltd. (“SecretUndies”, “we”) and all registered users of the SecretUndies.com platform (“platform”). They apply to all features and modules, including the Coins system, the chat and community areas, and the ranking system.

(2) “Users” are natural persons with an account, regardless of whether they act as sellers or buyers. Contracts for the purchase of items are concluded exclusively between the buyer and the seller. SecretUndies provides the technical infrastructure and platform services.

(3) “Items” are goods offered for sale, in particular second-hand intimate clothing (worn or unworn) and complementary products, insofar as they are permitted under the applicable laws at the place of residence of the users involved.

(4) “Coins” are digital usage or credit points that do not have legal tender status; they are intended exclusively for additional digital features within the platform.

§ 2 Subject matter of the contract and the platform’s role as a marketplace

(1) SecretUndies operates an online marketplace that brings buyers and sellers together. SecretUndies is not the seller of the items offered through the platform.

(2) SecretUndies provides technical platform services (e.g. account management, display of listings, communication features, payment and payout infrastructure, abuse prevention and moderation). SecretUndies does not offer sexual services or act as an intermediary for such services.

(3) It is prohibited to initiate or arrange meetings, offline handovers, escort, companionship or other personal services through the platform. Such offers or requests may be removed; accounts may be suspended.

(4) SecretUndies does not guarantee the actual processing, performance or enforcement of contracts concluded between users and, in particular, is not liable for defects, quality, condition, hygiene standards or the legality of the items offered. Mandatory statutory liability remains unaffected.

§ 3 Registration and user accounts

(1) Use requires registration and a personal user account. Only adults with full legal capacity (18+) are permitted to use the platform. SecretUndies may require proof of age.

(2) Users confirm that the information they provide when registering is truthful and update it without delay if it changes. Multiple accounts, concealment of identity or the use of another person’s data are prohibited.

(3) Login credentials must be kept confidential. Users are liable for activities carried out using their credentials to the extent that they are at fault.

(4) SecretUndies may decline registrations or suspend accounts where there are indications of abuse, breaches of the law or breaches of these GTC or the Terms of Use.

§ 4 Seller packages and platform fees

(1) The platform fees, package prices, billing intervals and contract durations agreed in the relevant seller package or subscription apply to sellers. The agreed conditions are set out in the relevant offer and contract confirmation.

(2) Platform fees from product sales and agreed package or subscription prices are charged separately. Seller ranks may be associated with status features and visibility benefits; they do not determine the platform fee.

(3) The conditions agreed for each existing subscription continue to apply. A subsequent change to the package, subscription or rank does not retroactively change the fees agreed for sales already concluded.

(4) Changes to the price, billing interval or essential scope of services of an existing seller package or subscription are offered separately. Before confirmation, we state the previous and new total prices, including applicable taxes, the billing interval, when the change begins, the changed services and any prorated billing, including credit for periods already paid for.

(5) Such a change takes effect only through an express agreement with the seller concerned. Silence, continued use of the platform and merely making new GTC available do not replace this consent. This applies regardless of the amount of an increase, including increases of less than 5 euros per month. Until a valid agreement is reached, the existing contractual conditions continue to apply. Billing periods and product sales already concluded are not made more expensive retroactively by a later change.

§ 5 Coins system

(1) Acquisition: Users may voluntarily purchase Coins through external payment service providers (e.g. Stripe or equivalent providers). The purchase grants a licence to use additional digital features. This is digital content not supplied on a tangible medium within the meaning of the relevant consumer protection provisions, where applicable.

(2) Use: Coins are used exclusively to purchase additional digital features (e.g. visibility or access to optional features). Coins are not a means of payment for purchasing items and do not replace payment between the buyer and the seller.

(3) No entitlement to a payout: Coins have no monetary value outside the platform, cannot be exchanged back or transferred, and expire when the account is terminated. Payouts in fiat or cryptocurrencies are excluded.

(4) Breaches or suspension: In the event of breaches of the law or the terms of use, suspension or termination, SecretUndies may revoke or deactivate Coins. The same applies to abuse, manipulation or unauthorised technical interference.

(5) Changes: SecretUndies may adjust or discontinue Coin offers, prices and features. Coins already redeemed will not be refunded. Statutory warranty rights remain unaffected. SecretUndies is not liable for damage resulting from unauthorised access by third parties unless SecretUndies is at fault.

(6) Not a payment service: The Coins system is neither a payment account nor an e-money product. Coins are not tradable and cannot be used for payouts or transfers to other users.

§ 6 Users’ obligations

(1) Users must comply with the applicable laws at their place of residence, these GTC and the Terms of Use. Items offered must be lawful and must not infringe third-party rights.

(2) Sellers must truthfully describe the condition of items (in particular, whether they are “worn” or “unworn”), package them properly and maintain appropriate hygiene standards. There is no obligation to clean items unless national legislation provides otherwise.

(3) Distributing, requesting or covertly transmitting personal contact details or external communication and payment methods through the platform is prohibited. This includes, in particular, email addresses, telephone numbers, messenger or social media profiles, external shop links, payment details and wording that is recognisably intended to initiate contact or payment outside SecretUndies.

(4) Actions that endanger the safe operation of the platform, in particular malware, spam or other harmful activities, are prohibited.

(5) Offers or content aimed at selling, supplying or promoting bodily fluids or biologically hazardous materials are prohibited. This includes, in particular, blood, urine, semen, faeces, menstrual blood or comparable content or related announcements.

(6) Sellers must package and ship items in a way that poses no health risk and complies with transport regulations. SecretUndies may require evidence of shipping confirmation or a tracking number before making payouts.

(7) The platform must not be used to coordinate prohibited content, unlawful acts or circumvention of the platform rules.

(8) Any circumvention of the platform’s processes is prohibited. This applies, in particular, where sellers or buyers attempt to handle communication, payment, delivery, complaints or repeat purchases outside SecretUndies in order to bypass platform fees, buyer protection, moderation, record-keeping or payment processes. Such an attempt constitutes a serious breach of the rules and of the contract.

§ 7 Formation of contracts

(1) Sellers’ listings constitute invitations for buyers to make an offer (invitatio ad offerendum). The purchase contract is concluded through matching declarations of intent by the users.

(2) SecretUndies provides technical features for this purpose (e.g. messages, a shopping cart and payment processing through third parties). SecretUndies does not confirm purchase contracts or guarantee their substantive terms.

(3) Sellers are responsible for consumer protection information duties where applicable. Before concluding a contract, buyers must independently check whether the purchase is legally permitted.

§ 8 Payment processing, payouts and fees

(1) SecretUndies uses external payment service providers (e.g. Stripe) and, where available, marketplace or split-payment infrastructure (e.g. Stripe Connect) to process payments. The terms of the relevant payment service provider also apply.

(2) Sellers bear financial responsibility for their listings and transactions. They authorise SecretUndies to process payments technically, withhold platform fees under § 4 and initiate payouts in accordance with these GTC and the terms of the payment service providers.

(3) Payouts may depend on the required identity and/or age verification (KYC) having been completed with the payment service provider and on complete payout details (e.g. bank details) having been provided.

(4) Payouts to sellers are released no earlier than 21 calendar days after a valid tracking number or equivalent proof of shipment has been submitted or entered. This is subject to there being no pending disputes, refunds, chargebacks, fraud reviews or policy reviews, and to the requirements under these GTC and the terms of the payment service providers being met.

(5) SecretUndies may temporarily withhold payouts where this is necessary to prevent abuse, resolve disputes, fulfil legal obligations, process payment reversals or chargebacks, or investigate a breach of the rules. This applies, in particular, to unusual transactions, an increased refund rate, missing or implausible proof of shipment, or suspected circumvention of the platform.

(6) In the event of confirmed breaches, SecretUndies may cancel transactions, refund buyers, withhold pending payouts and set off platform fees due, payment service provider fees, refunds, chargebacks, damages or reasonable review and enforcement costs against payout claims, to the extent legally permitted and attributable to the specific transaction. There is no blanket forfeiture of undisputed balances; undisputed remaining amounts are paid out after the review has been completed, provided there are no statutory or contractual counterclaims.

(7) Payment service provider fees (e.g. transaction charges) are governed by the provider’s terms. To the extent attributable, they may be taken into account proportionately when making payouts.

§ 8a Refunds, disputes and chargebacks

(1) Refunds are generally made by the seller in accordance with the agreement with the buyer and applicable law.

(2) In the event of payment disputes, chargebacks or suspected fraud, payment service providers may withhold or reclaim amounts. Sellers bear the financial consequences of chargebacks to the extent attributable to their transaction. SecretUndies may set off the corresponding amounts against payouts or temporarily withhold them.

(3) SecretUndies may provide technical information to assist in resolving disputes (e.g. order and shipping data, and communication histories to the extent legally permitted), but does not guarantee decisions made by the payment service provider or a bank.

§ 9 Right of withdrawal (C2C/B2C)

(1) As purchase contracts are generally concluded between private individuals, the statutory right of withdrawal for distance contracts does not typically apply. Users may voluntarily agree on more extensive return rights.

(2) Where sellers act as traders within the meaning of consumer protection laws, they alone are responsible for information duties and obligations relating to consumers’ right of withdrawal.

(3) SecretUndies provides information features but does not give legal advice or assume responsibility for users’ fulfilment of their legal obligations.

§ 10 Liability and status as a hosting provider

(1) SecretUndies provides hosting services under Article 6 of the Digital Services Act (DSA) and Article 14 of Directive 2000/31/EC. Statutory liability for third-party content applies, in particular, where there is knowledge of unlawful content and a failure to act without delay.

(2) SecretUndies has unlimited liability for intentional misconduct and gross negligence. In cases of slight negligence, SecretUndies is liable only for breaches of essential contractual obligations (cardinal obligations), limited to foreseeable, typical loss.

(3) Liability for loss of profit, indirect damage or consequential damage is excluded to the extent permitted by law. Mandatory statutory liability (e.g. product liability or injury to life, body or health) remains unaffected.

§ 11 Suspension and termination

(1) SecretUndies may restrict, temporarily suspend or terminate user accounts without notice where there are reasonable indications of serious breaches, illegal content or abuse. Serious breaches include, in particular, fraud, fake listings, unlawful content, repeated harassment, manipulation, chargeback abuse and the sharing of email addresses, payment details or other external contact methods to circumvent the platform’s processes or platform fees.

(2) Reasons for a suspension or termination are provided in advance or without delay afterwards, to the extent legally required and practically possible. Affected users may have the decision reviewed through the designated support or complaint channels.

(3) Users may terminate their account at any time without a notice period. Fees, refunds, chargebacks, claims for damages or claims for reimbursement of expenses already owed remain due.

(4) Unredeemed Coins expire upon termination or suspension. Rights or claims between users arising from transactions already entered into remain unaffected to the extent legally permitted. Under § 8, payouts may be withheld until outstanding matters have been resolved and set off against attributable counterclaims; undisputed remaining balances are not subject to blanket forfeiture.

§ 12 Data protection

(1) Personal data is processed in accordance with the GDPR, Cypriot data protection law and applicable national provisions. The current Privacy Policy is available at /datenschutz/.

(2) Moderation decisions, notice-and-action procedures and statements of reasons are documented in accordance with the DSA. Users are given access to relevant information on request, to the extent legally permitted.

(3) SecretUndies uses technical measures (including banned-word lists and automated filters) to detect and remove unlawful content. A complete prior review of all content is not possible.

§ 13 Choice of law, jurisdiction and changes to the GTC

(1) The law of the Republic of Cyprus applies, excluding its conflict-of-laws rules. Mandatory consumer protection provisions of the users’ country of residence remain unaffected.

(2) If users are merchants, legal entities under public law or do not have a general place of jurisdiction in Cyprus, the registered office of SecretUndies is the exclusive place of jurisdiction, to the extent permitted.

(3) Amendments and additions to these GTC must be in text form. SecretUndies gives notice of material changes at least 14 days before they take effect. If users do not object within this period, the changes are deemed accepted, to the extent permitted by the law applicable to them. This provision on objections and silence does not apply to changes to prices, billing intervals or the essential scope of services of existing seller packages and subscriptions; section 4, paragraphs 4 and 5 apply to those changes.

Part 2: Terms of Use (House Rules)

§ 1 Scope and relationship with the GTC

(1) These Terms of Use specify the GTC in greater detail and apply to all interactions on the platform, in particular in community areas, messages, item listings and activities.

(2) In the event of a conflict, more specific provisions of these Terms of Use take precedence over the general provisions of the GTC; in all other respects, the GTC remain authoritative.

§ 2 Registration, security and proof of age (18+)

(1) The platform is intended exclusively for adults. SecretUndies may require proof of identity or age at any time. Use by minors is prohibited.

(2) Login credentials must be kept secret and strong passwords must be used. Suspected unauthorised access must be reported without delay.

(3) Sharing accounts or knowingly allowing their use by third parties is not permitted.

§ 3 Rules of conduct

Respectful conduct: Harassment, bullying, hate speech, threats and discrimination are prohibited. Communication must be courteous and respectful.

Discretion and anonymity: Personal or identifying content must be avoided. Product photos must not show faces, identifiable tattoos or other clear identifying features where this would contravene the platform rules.

No external contacts: Offering, requesting or concealing personal contact details or external platforms (e.g. telephone, WhatsApp, Telegram, Instagram, OnlyFans, email, external shops or payment links) is prohibited.

No circumvention of the platform: Initiating or carrying out offline deals, direct payments, external repeat purchases, meetings or personal services is prohibited. Payments and communication must take place through the designated platform processes. Anyone attempting to induce buyers or sellers to circumvent SecretUndies or platform fees risks restrictions, suspension, cancellation of the affected transactions and the withholding or set-off of the affected payouts under § 8.

§ 4 Content

Permitted depictions: Lawful, consensual, non-pornographic depictions focusing on the product offered are permitted. Anonymous, aesthetic product photos without explicit sexual activity are permitted, provided they comply with the other rules.

Prohibited content: In particular, pornographic content, content relating to minors, content glorifying violence, discriminatory content, drug-related content or other unlawful content is prohibited. Content that depicts or suggests sexual acts is prohibited. Depictions of persons unable to consent or of animals are also prohibited, as are content and offers relating to bodily fluids or biologically hazardous materials within the meaning of the GTC.

External advertising: Advertising other services or platforms without SecretUndies’ prior express written consent is prohibited.

§ 5 Community and chat

(1) Communication takes place exclusively through the platform. Automated bulk messages, spam and chain letters are prohibited.

(2) SecretUndies uses measures including banned-word lists and automated filters to prevent illegal, pornographic, minor-related or external contact attempts. Affected messages may be blocked or their delivery delayed.

(3) Sexting, explicitly erotic conversations or the sending of pornographic content through the chat are prohibited. SecretUndies may review messages where there is a legitimate reason (e.g. a report of a breach) and this complies with applicable law.

(4) Breaches may lead to warnings, restrictions or suspension. Affected users receive a statement of reasons under Article 17 DSA where required.

(5) Sharing email addresses, telephone numbers, messenger contacts, payment details or comparable instructions for circumventing the platform in the chat is a serious breach. This also applies where the wording is indirect or concealed but is recognisably intended to lead to a sale, payment or subsequent communication outside the platform.

§ 6 Rules for item listings

(1) Only legally permitted items are allowed. Medical products, prescription-only products, products hazardous to health and third parties’ hygiene products are prohibited.

(2) The condition (“worn” or “unworn”) must be stated truthfully. Second-hand intimate clothing is permitted where the transaction is voluntary and hygienic, discreet packaging is ensured.

(3) Sellers must ensure that the items pose no health risk. Items must be stored and shipped in closed, suitable containers.

(4) Sham transactions, fake listings and manipulation are prohibited.

§ 7 Rights to use user-generated content (UGC)

(1) By uploading content, users grant SecretUndies a non-exclusive, worldwide right, free of charge, to store, host, reproduce, distribute and make the content publicly accessible for the operation of the platform.

(2) This serves the technical provision of the platform (e.g. caching, backups and content delivery). Content is edited only to the extent necessary for display or moderation.

(3) Users warrant that they hold the necessary rights and do not infringe any third-party rights.

§ 8 Ranks, visibility and fairness

(1) Ranks are based on transparent parameters defined by SecretUndies. Manipulation, purchased reviews, fake accounts or collusive activities to increase rank or visibility are prohibited.

(2) SecretUndies may lower ranks or adjust visibility where there are indications of abuse.

(3) Decisions on rank changes may be challenged through the internal complaint procedure.

§ 9 Moderation and DSA procedures

(1) SecretUndies operates a notice-and-action system. Reports of unlawful content may be submitted through the designated forms or contact channels. Reports are reviewed promptly and appropriate measures are taken.

(2) Affected users receive a statement of reasons under Article 17 DSA setting out the measure, its contractual or legal basis, and the available remedies.

(3) An internal complaint procedure (appeal) is available. Complaints may be submitted in writing within six months of receiving the statement of reasons. SecretUndies makes a decision within a reasonable period and communicates the outcome.

(4) SecretUndies cooperates with trusted flaggers under Article 22 DSA; their reports are processed as a priority.

§ 10 Final provisions (Terms of Use)

(1) Breaches may lead to warnings, restrictions, temporary suspensions or permanent bans. SecretUndies may remove or disable content. In cases of circumvention of the platform, attempts at external contact or payment, or other serious breaches, affected transactions may be reviewed, held, cancelled, refunded or set off against attributable counterclaims; § 8 of the GTC governs these matters.

(2) Changes to the Terms of Use are announced at least 14 days before they take effect. Continued use constitutes acceptance to the extent permitted under applicable law.

(3) If any individual provision is invalid, the validity of the remaining provisions remains unaffected. Where necessary, the invalid provision is replaced by a provision that comes closest to its economic purpose.

Seven introductory days for new seller subscriptions

An expressly offered introductory deal is available once per customer for their first paid seller subscription. The one-time introductory price covers only seven days. The chosen regular monthly, quarterly or annual term then begins at the agreed renewal price and renews automatically at that interval. The introductory price, regular price, term and start of regular billing are clearly displayed before purchase and recorded in the confirmation. Customer cancellation before the seven introductory days end prevents the first regular payment; paid access continues until the introductory period ends. Statutory withdrawal rights remain unaffected. Existing contracts keep their agreed terms.
